At 38.2 against a 43.3 bust, the waist is the narrow point. That is what empire means in practice: the seam sits high, so the measurement is taken at the ribcage rather than the middle.
49.6 inches at XL and 50.4 by 3XL, while the bust grows by more than six inches over the same span. Sizing up buys width rather than length, so the hem sits higher on a taller wearer whichever size is chosen.
